All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.

Further, by agreeing to be bound by these Terms and providing or inputting your information into our system you give express permission and agree to us contacting you via emails and SMS messages from time to time (until you opt out in accordance with the opt out options provided in the email or SMS or in accordance with our Privacy Policy terms) which emails and SMS messages may include but are not limited to services updates, campaign updates, payment reminders, advertising reports and marketing opportunities. This includes for in store purchases & transactions also.

Order Acceptance and Cancellations

Elite Supplements reserves the right to cancel or refund any order prior to dispatch, even if it has already been accepted. This may occur under various circumstances, including but not limited to:

Supplier Constraints: When our suppliers are unable to provide the goods as initially expected or promised.

Unforeseen Events: Situations beyond our control such as natural disasters, pandemics, or acts of terrorism that prevent us from fulfilling the order within a reasonable timeframe.

Website Errors: Inaccuracies on our site relating to product descriptions, pricing, or images.

Fraud & Abuse Prevention: Elite Supplements reserves the right to refuse service, cancel orders, restrict payment methods, or suspend accounts where fraudulent activity, excessive claims, or abuse of returns or chargeback. If your order is cancelled, you may receive a refund via your original payment method or a gift card with added bonus value, this will be determined at our discretion.

Order Modifications

Orders may be eligible for modification within 30 minutes of placement. For more information, please refer to our FAQs.

Pre-Orders

By placing a pre-order, you acknowledge the product is not immediately available for dispatch. Estimated delivery dates may change. Pre-orders are charged in full at time of purchase. Please also note, we may split shipments to speed up delivery. Each parcel will be tracked individually.

Shipping, Exchanges, Refunds & Returns

Price Variations Between Online and In-Store

Please note that our pricing may differ between our online store and physical Elite Supplements retail locations. These differences arise due to factors such as:

  • Stock availability at each location
  • Ongoing or exclusive promotional activities
  • Shipping and logistics considerations

Online prices are tailored for purchases made via our website and may not reflect prices available in-store. This approach is consistent with common Australian retail practices and complies with Australian Competition and Consumer Commission (ACCC) guidelines.

Incorrect Shipping Information

Customers are responsible for ensuring all contact and shipping details are accurate at checkout. Elite Supplements is not liable for orders delivered to an incorrect address supplied by the customer. Orders returned due to incorrect or incomplete address details may incur additional shipping fees for re-delivery.

Delivery Confirmation & Proof of Delivery

All orders are deemed delivered once marked as delivered by the carrier to the delivery address provided at checkout.

All orders are shipped using courier services that deliver parcels via Safe Drop in accordance with the carrier’s delivery policies.

Elite Supplements does not offer or require customers to provide Authority to Leave. Where a courier elects to leave a parcel unattended at the delivery address or a location they deem safe, this is done under the carrier’s standard delivery practices.

Once delivery has been marked as delivered by the courier, liability for the order transfers to the customer. Elite Supplements is not liable for loss, theft or damage occurring after the confirmed delivery by the courier. 

Customers who require secure delivery are encouraged to provide an attended delivery address, use a PO Box or parcel locker, or make alternative delivery arrangements prior to dispatch.

Missing, Incorrect or Damaged Items

Any claims relating to missing, incorrect, or damaged items must be submitted within 48 hours of delivery, supported by clear photographic evidence of the parcel, packaging, and contents.

Claims submitted outside this timeframe will not be accepted. All orders are scanned, weighed, and recorded during packing prior to dispatch.

Evidence Requirements

Elite Supplements reserves the right to request additional verification prior to approving refunds, replacements, or store credit. This may include:

  • Photographs of the shipping box and internal packaging
  • Images of damaged or incorrect items
  • Unboxing videos
  • Proof of delivery or identity verification

Failure to provide requested evidence may result in the claim being declined.

Promotions, Discounts and Free Gifts

Promotions may be limited to:

  • Website only or selected stores
  • Full-priced items
  • One use per customer

Discount codes cannot be stacked and generally do not apply to clearance items, bundles, or ready-to-drink (RTD) products unless otherwise specified.

Free gifts apply to orders over $100 while stocks last. Bundle promotions offering free items are limited to one free item per customer per qualifying purchase unless expressly stated otherwise.

Special Campaigns & Offers

Special campaigns (including giveaways and seasonal promotions) are subject to separate terms, eligibility requirements, and expiry dates outlined on relevant campaign pages.

Freight Protection (Easy Protection)

Easy Protection is an optional service offered at checkout covering loss, damage, or theft during transit.

Easy Protection Conditions

  • Non-refundable once the order has been dispatched
  • Limited to one claim per customer or shipping address per calendar year
  • Claims may be denied where there is evidence of negligence, fraud, confirmed delivery to the correct address, or where the product remains safe and functional
  • Resolution may be provided as store credit or replacement at Elite Supplements’ discretion
  • Refunds are not available for transit-related issues, with or without Easy Protection
  • Easy Protection does not extend or override the 48 hour claim requirement for missing or incorrect items
  • Easy Protection does not cover orders that go missing or are stolen after they have been delivered.

Claim Requirements

  • Claims must be submitted within 48 hours of delivery
  • Photographic evidence is required
  • Return of the product may be required using a prepaid return label

Orders without Easy Protection are not eligible for Elite Supplements support relating to transit damage.

Click & Collect

Click & Collect is available at participating stores and subject to stock availability. Orders are typically ready within 1 - 2 business hours during store opening hours. Collection requires valid photo ID matching the nominated collector name and the 6 digit collection code.

Orders not collected within 14 days will be cancelled and refunded as store credit issued via email for online use only.

Returns & 30 Day Money Back Guarantee

Elite Supplements offers store credit or exchange for unopened products returned within 30 days of shipping. Opened items may only be returned if confirmed faulty.

Original shipping fees are non-refundable. Return shipping costs may be deducted unless the item is confirmed faulty.

Elite Supplements reserves the right to deny returns where:

  • Products are opened or used
  • Items are clearance or short-dated
  • Requests are outside the eligible period

Damage caused during transit is not considered a product fault.

International Returns

International customers are responsible for return shipping costs. Tracked shipping is strongly recommended. Elite Supplements is not liable for international returns lost or damaged in transit unless Easy Protection was purchased.

Gift Cards

Gift cards are valid for 3 years from purchase unless promotional. Gift cards are treated like cash and cannot be replaced if lost, exchanged for cash, or refunded.

Consumer Guarantees

Elite Supplements complies with Australian Consumer Law. Your statutory rights are not affected by these Terms.

Fraud, Abuse & Account Restrictions

Elite Supplements reserves the right to refuse service, cancel orders, restrict payment methods, suspend or terminate accounts where fraudulent activity, excessive claims, return abuse, or chargeback misuse is suspected.

Chargebacks

Customers agree to contact Elite Supplements directly to resolve order issues prior to initiating a chargeback. Excessive or abusive chargebacks may result in account suspension or refusal of future service. Transaction and delivery records may be provided to financial institutions to dispute chargebacks.

Consumer Guarantees

We guarantee our products are of acceptable quality and accurately described. Faulty goods refer to issues such as broken or missing seals, visible manufacturing defects, or expired goods at the time of delivery (unless you were made aware of the short-dated status before purchase). Damage occurring during transit is not considered a product fault. Some imported goods may have varying label information.

Your rights under the Australian Consumer Law remain unaffected. Where goods are faulty, not as described, or incorrectly supplied, you may be entitled to a store credit, replacement, or refund in line with the law.

Indemnification

You agree to indemnify and hold harmless Elite Supplements and its affiliates from any claims resulting from your breach of these Terms or your misuse of this website.

Third Party Links

We may link to third party websites. We do not control these sites and are not responsible for their content, privacy practices, or services.

Rewards Program

5% cashback in the form of Rewards Credits is earned on eligible purchases. Credits:

  • Can be redeemed online or instore (your choice is locked in)
  • Cannot be transferred or exchanged
  • Expire after 365 days of account inactivity

Limitation of Liability

We are not liable for indirect, incidental, or consequential damages arising from your use of our site or products, except as required under Australian law.

App Payments and Subscriptions 

App subscriptions may be monthly, quarterly, or yearly. Renewal is automatic unless cancelled 24 hours before the renewal date.
Please refer to the platform (App Store or Google Play) for managing subscription preferences.

Governing Law

These Terms are governed by the laws of Australia. Any disputes will be resolved in Australian courts.

Term; Termination

These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Elitesupps.com.au without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Elitesupps.com.au may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Elitesupps.com.au.

Miscellaneous

Your use of this site shall be governed in all respects by the laws of Australia. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Elitesupps.com.au products) shall be in the state or federal courts located in Australia. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Elitesupps.com.au products) must be commenced within one (1) year after the claim or cause of action arises. Elitesupps.com.au failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Elitesupps.com.au or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libellous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law.
